Terms and Conditions
1. Definitions
1.1 Agency: KiwiOz Nannies
1.2 Client: A person seeking to find an Employee using the services of the Agency
1.3 Employee: A person seeking employment with a Client using the services of the Agency
1.4 Third Parties: Any person not directly engaged in business with the Agency
1.5 Agency Fees: Fees due to the Agency from the Client
2. The Client Agrees
2.1 That if an Employee introduced by the Agency is interviewed by the Client this constitutes
acceptance of these terms, conditions and fees.
2.2 To notify the Agency if an Employee introduced through the Agency has been offered employment by the Client.
3. Agency Fees
3.1 Invoices for payment will be sent on confirmation of employment.
3.2 A temporary placement through KiwiOz Nannies is a placement that does not exceed twenty weeks in duration. If an employee is required to work for more than twenty one weeks, the placement will be classed as a permanent position and will be charged for accordingly.
3.3 Agency fees are as follows:
Permanent Placements (Greater than 20 weeks):
Full time permanent placements (30 hours+ per week): 3.5% of the nanny’s gross annual salary + GST
Part time permanent placements (10 – 29 hours per week): 5% of the nanny’s gross annual salary + GST
Part time permanent placements (if <10 hours per week): 10% of the nanny’s gross annual salary + GST
Please Note: There is a 3 hour minimum for all bookings
Overseas permanent placements, outside Australia or NZ: 15% of the nanny’s gross annual salary + GST
**A permanent placement fee will be charged based on the nanny’s annual earnings even if the contract is greater than 20 weeks but less than 12 months.
Temporary Daily Placements:
All temporary nanny placements through KiwiOz are $25 per hour
This includes GST, agency booking fee, wages, annual leave, statutory holidays, ACC premiums and all payroll processing costs.
Please Note: There is a 3 hour minimum for all daytime temporary nanny bookings
Fixed Term Temporary Placements:
Per week for 6-10 weeks Agency fee is $80 + GST
Per week for 11-20 weeks Agency fee is $60 + GST
The family must pay the nanny direct through their preferred payroll system
Temporary Live in Placements: Per 24 hours (incl. weekends) $25 per day + GST booking fee
Maternity Nurse Placements: $90 + GST per week agency booking fee
Evening Babysitting (after 6.30pm)
Booklet of five bookings to be used after 6:30pm $100 + GST
Annual fee (unlimited babysitter bookings for 52 weeks) $350 + GST
** Should the agency be unable to fulfil a booking for a babysitter to an annual subscriber, or should the booking not be fulfilled by the babysitter arranged, provided two working days notice has been given, the client will receive an additional one week membership at the end of the annual subscription.
Please Note: There is a 3 hour minimum for all babysitter bookings
4. Payment
4.1 The Agencies account must be payed in full within fourteen days of the date of the invoice.
4.2 Payment can be made by Internet banking transfer, credit card or Cheque made out to KiwiOz Nannies Limited.
4.3 If the payment is settled in accordance with clause 4.1 the Client will qualify for the guarantee referred to in clause 7.
5. Late Payment
5.1 The Agency reserves the right to charge the Client 15% uplift per month on the agreed Agency Fee on all accounts not settled within fourteen days of the invoice date. Unpaid accounts will incur all collection costs.
6. Cancellations of Employment
6.1 In the case of a Client cancelling the employment before the Employee has started work, the Agency will charge the Client 25% of the applicable agency fees.
6.2 In the case of an Employee cancelling the employment before the Employee has started work, a full refund will be given to the Client.
6.2 With Temporary Placements if the employment is cancelled by the employer within 2 weeks of the start date a cancellation fee is due to the nanny of 20% of her gross wages.
6.3 If a temporary booking is cancelled within 24 hours of the start date 50% of the total wage is due to the nanny.
7. Guarantee
7.1 The Guarantee will only be applicable to invoices settled within the 14 day payment period.
7.2 Once the placement has commenced employment refunds will be payable to the Client according to the time periods set out below:
0-14 days (from job start date) 100% refund less a $75 administration fee
15-28 days 80% refund of total amount paid
29-42 days 60% refund of total amount paid
43-56 days 40% refund of total amount paid
7.3 Refunds will only be payable to the Client if the employment has been terminated due to the unsuitability of the Employee to the position.
7.4 Refunds will only be payable to the Client if the Client has informed the Agency in writing of the fact within seven days of the date the employment was terminated.
7.5 A booking is deemed satisfactory after 56 days and thereafter no refund will be payable.
8. Liability
8.1 The Agency is an introduction and booking agency only- Employees are not directly or indirectly employees of the Agency in permanent employment roles.
8.2 Employees are always employed by the Client, except where the Employee elects to be self employed or is working as a temporary nanny. The final decision on the suitability of the Employee is the sole responsibility of the Client.
8.3 Whilst the Agency makes every reasonable effort to ensure the suitability of Employees, we cannot be held responsible for any loss, damage or personal injury resulting from the Agency’s introduction.
9. Confidentiality
9.1 All introductions made by KiwiOz Nannies are confidential.
9.2 Clients introducing Nannies to Third Parties will be liable for the payment of our Agency Fees as if the Agency had made the introduction, and these Terms and Conditions shall apply accordingly.
10. General
10.1 The Agency reserves the right to change these Terms and Conditions of Business without prior notification.
